1. Acceptance of Terms
By accessing and using the AI Risk Hub platform provided by VAN DEN ELSHOUT LTD ("we", "us", "our"), you agree to be bound by these Terms of Service. If you are accepting on behalf of a company, you represent that you have the authority to bind such entity to these terms.
2. Description of Service
AI Risk Hub is a SaaS platform designed to help organizations assess their AI systems against the requirements of Regulation (EU) 2024/1689 (the "AI Act"). The platform generates compliance roadmaps and document templates based on user input.
3. Subscriptions and Payments
Some features require a paid subscription or one-time purchase. Payments are processed securely via Stripe. Subscriptions are billed in advance on a recurring basis. You may cancel your subscription at any time, but no refunds will be provided for partial months.
4. User Responsibilities
- You agree to provide accurate information regarding your AI systems.
- You will not use the platform for any illegal or unauthorized purpose.
- You are responsible for maintaining the security of your account credentials.
5. Limitation of Liability
To the maximum extent permitted by applicable law, VAN DEN ELSHOUT LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any regulatory fines (including those issued under the AI Act) resulting from your use of the platform. In no event shall our aggregate liability exceed the total amounts paid by you to us in the twelve (12) months immediately preceding the claim, or €100, whichever is greater.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.
